Kwik Konekt is a product and service of Claricon Consult (“Claricon”, “we”, “us” or “our”). Claricon Consult is the contracting party responsible for providing the Services. These Terms govern the Kwik Konekt website, digital profiles, NFC cards and tags, QR codes, review cards, digital call cards, related products, software and support services (“Services”). By ordering, activating, managing or using a profile, scanning or tapping a product, you agree to these Terms and our Privacy Policy. If acting for an organisation, you confirm that you are authorised to bind it.

1.. Definitions “Customer” means a person or organisation purchasing or managing a product or account; “Cardholder” is the person or organisation assigned a card or profile; “Visitor” scans, taps or views a profile; “User Content” is material submitted or displayed through the Services; and “Digital Profile” is the online page or destination linked to a card, QR code or NFC tag.

2..Services and compatibility Products may direct compatible devices to a Digital Profile or configured destination and may include contact sharing, business or personal profiles, links, review destinations, profile editing, QR management and analytics. Features vary by product, plan and configuration. NFC requires a compatible device and settings; QR use may require a camera/reader and internet access. We do not control device, browser or operating-system compatibility.

3..Orders, customisation and delivery Images and mock-ups are illustrative; colours, finishes, dimensions and print results may vary. Orders are subject to confirmation, availability, payment authorisation and accurate details. You must check names, spelling, logos, contact details and destinations before approving production. Delivery dates are estimates unless confirmed otherwise; delays may arise outside our control. Shipping, cancellation, return, exchange and warranty terms will be disclosed at checkout or separately. Non-excludable consumer rights remain unaffected.

4.. Accounts and security Account verification is required to use the platform. Provide accurate, current information, keep it updated and protect your credentials. You are responsible for restricting account access. Promptly report suspected unauthorised access, loss of a card or account compromise to kwikkonekt@gmail.com. Do not impersonate others, use false information or access another account without permission.

5.. User Content and responsibility You are responsible for content uploaded or made accessible through your profile or QR/NFC destination and must have the rights, permissions and lawful authority to use it and share personal information. Do not upload unlawful, fraudulent, defamatory, threatening, harassing, discriminatory, obscene, misleading or harmful content; publish another person’s personal or protected material without authority; facilitate scams, phishing, spam, impersonation, malware or unlawful marketing; or upload sensitive personal data unless the feature and legal requirements permit it. Keep information accurate and remove outdated or unauthorised content. You retain ownership of User Content but grant Claricon a limited, non-exclusive, worldwide, royalty-free licence to host, store, display, transmit and technically adapt it as necessary to provide, maintain, secure and support the Services. The licence ends on deletion, subject to backups, legal duties and reasonable retention.

6.. Public visibility Unless expressly marked private or access-restricted, profiles and destinations may be viewed by anyone with the link or who scans or taps the product. Treat profile information as public. Visitors may save details, take screenshots or retain information independently of Kwik Konekt.

7.. QR codes, NFC and destinations Codes and tags provide access to a link, identifier or configured destination; operation depends on accurate configuration and destination availability. Do not tamper with, clone or reprogramme products to bypass security or infringe rights. You are responsible for destinations you select. Claricon may disable unlawful, unsafe, deceptive, malicious, infringing or risky destinations. Printed codes or encoded tags may not be physically changeable after manufacture; redirection depends on the online service and technical configuration.

8.. Review cards and third parties Cards may direct visitors to Google or other review, rating, social, messaging or third-party platforms. Claricon does not control their availability, policies, content, moderation, ratings or data practices; their own terms and privacy policies apply. Do not fabricate or manipulate reviews, suppress negative feedback, or incentivise reviews contrary to platform rules. Third-party names and logos remain their owners’ property and do not imply endorsement.

9.. Fees, free access and future pricing The current digital profile offering has no recurring subscription fee for included features. This is not a promise of lifetime access, hosting, editing or permanently free use. Claricon may introduce subscriptions, renewal charges, paid features, limits or alternative plans, or modify, suspend or discontinue Services, subject to law. Where reasonably practicable, we will give advance notice of material changes, fees, effective dates and options. If hosting or editing becomes chargeable, options may include a paid plan, alternative plan, export or retention of available information, or external QR redirection where technically supported. Options depend on the change and technical capabilities. Unless agreed in writing, an NFC product purchase covers only digital features expressly included at purchase; it does not guarantee perpetual hosting, unlimited editing or uninterrupted operation.

10.. Acceptable use Comply with applicable law. Do not use the Services unlawfully or infringe rights; test or bypass security without authorisation; introduce malware, scraping or disruptive automation; reverse engineer, copy, resell or sublicense the platform except as permitted; interfere with another user’s account, profile, card or data; or send unsolicited bulk, deceptive, abusive or unlawful marketing.

11.. Intellectual property Claricon and its licensors own or license the platform, software, designs, branding, logos, layouts and documentation, excluding User Content and third-party materials. You receive a limited, revocable, non-transferable, non-exclusive right to use the Services as intended while complying with these Terms. No ownership transfers. Use of Claricon or Kwik Konekt branding requires written permission.

12.. Third-party services Services may rely on hosting, domain, analytics, payment, messaging, social, review, cloud, internet and telecommunications providers. They operate independently and may change their services or terms. Claricon is not responsible for their products, content, outages or privacy practices. Where providers process personal data for us, we will take legally required steps.

13.. Availability and maintenance Services depend on third-party infrastructure, connectivity and compatible devices. We make reasonable efforts to maintain them but do not guarantee uninterrupted, error-free or permanent availability. We may perform maintenance, updates, security interventions or feature changes and, where practicable, notify users of material planned interruptions.

14.. Suspension and termination You may stop using the Services and request account/profile closure at kwikkonekt@gmail.com. Claricon may restrict, suspend or terminate access as reasonably necessary to protect users, investigate fraud or security incidents, enforce these Terms, comply with law, address non-payment or respond to harmful content. Where appropriate and lawful, we will notify you and allow an opportunity to remedy the issue. On termination, profiles or destinations may stop operating, be redirected or disabled. Retain needed information before closure; deletion may be subject to backups, disputes, fraud prevention and legal retention.

15.. Privacy and data protection Personal data is handled as described in the Kwik Konekt Privacy Policy and in accordance with Ghana’s Data Protection Act, 2012 (Act 843) and other applicable law. If you upload another person’s data, you must have authority and a lawful basis and provide required notices.

16.. Disclaimers To the extent permitted by law, Services are provided “as available”. Claricon does not warrant that every device supports NFC/QR, third-party platforms remain available, visitors act on profiles, or products generate business, leads, reviews, sales or other outcomes. Mandatory warranties and consumer rights are not excluded.

17.. Liability To the maximum extent permitted by law, Claricon is not liable for indirect or consequential loss, lost profits, opportunity or goodwill, or interruption arising from third-party networks or services. Nothing excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, mandatory consumer rights, data protection obligations or liability that cannot legally be excluded.

18.. Indemnity To the extent permitted by law, you are responsible for claims, losses and reasonable costs arising from unlawful use, breach of these Terms or User Content infringing another person’s rights. This does not apply to the extent caused by Claricon’s own breach, negligence or unlawful conduct.

19.. Changes to Terms Claricon may update these Terms for changes to Services, law or operations. We will publish the revised version and date and give notice of material changes where reasonably practicable and legally required. We will obtain fresh consent where required by law.

20.. Governing law and disputes Ghanaian law governs, subject to mandatory consumer protections and other legal rights. Parties should first attempt good-faith resolution by contacting kwikkonekt@gmail.com. Unresolved disputes may be referred to a court of competent jurisdiction in Ghana. Consumers retain rights to approach a regulator or court where permitted.

21.. General If a provision is unenforceable, the remainder continues to apply. Failure to enforce a provision is not a waiver. You may not transfer your rights without written consent. Claricon may transfer its rights and obligations as part of a restructuring or business transfer, subject to law. These Terms, the Privacy Policy and applicable product-specific terms form the agreement concerning the Services.

23.. Interpretation and precedence If a product-specific term conflicts with these general Terms, the product-specific term applies only to that product or feature and only where it clearly identifies the variation. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.
